Terms of Service

These Terms and Conditions apply to your use of the MoneyPigeon products, and any other functionalities and technologies offered on the app, website, or through any other means (“Platforms”) by MoneyPigeon (“The Company” or “Us”). Please read them carefully as they affect your rights and liabilities under the law. By accessing the platforms, you are indicating your acceptance of these Terms and Conditions, and privacy policy. You are advised not to access our platforms if you do not agree to these Terms and Conditions.

1. Glossary

In this agreement:

  • App means the mobile application software, the data supplied with the software, and the associated media
  • Balance means any amounts held in your MoneyPigeon Account. 
  • Business Day means any day on which banks are open for business in the United States and the EU, excluding Saturdays, and Sundays. 
  • Local Taxes means any taxes chargeable in the Recipient’s country. 
  • MoneyPigeon Account means the account you have opened with us in accordance with the terms of this agreement. 
  • MoneyPigeon debit card means a debit card generated using the MoneyPigeon app and funded by you 
  • Money Transfer Amount means the specific sum of money which you push through your Account, to be transferred to the Recipient through the Platform. 
  • Money Transfer means an electronic transfer of a Money Transfer Amount by You to the Recipient through the Platform. 
  • Money Transfer History means records of Money Transfers that are accessible through the Platform. 
  • Payment Instruction: Payment Instruction means an instruction containing the execution of a Money Transfer, sent to MoneyPigeon by You (through the Platforms) 
  • Recipient means the payee, located in the Recipient’s Country, who receives the money through the use of the Money Transfer Service. 
  • Recipient’s Country means the country from where a Recipient receives the Money Transfer. 
  • Services mean all services provided by MoneyPigeon including but not limited to debit card generation and sending money abroad.  
  • Service Provider means technical partners, international transfer money operators, commercial banks, and third-party service providers with whom we work to provide the Services to You. 
  • Services mean all products, services, content, features, technologies, or functions offered by us and all related websites, applications (including the App), and services (including the Website and API). 
  • Source Currency means the currency which you hold and/or fund your payment order with. 
  • Target Currency means the currency which your recipient will receive. 

 

2. Amendments

We may update these Terms from time to time for legal or regulatory reasons or for the proper operation of the Site without any recourse to You whatsoever. Any changes will be notified to You via the e-mail address provided by You on registration or via a suitable announcement on the Platforms. The changes will apply to the use of the platforms after we have given notice. If You do not wish to accept the new Terms You should not continue to use the Site. If You continue to use the Site after the date on which the change comes into effect, Your use of the Site indicates Your agreement to be bound by the new Terms and Conditions. 

 

3. Eligibility and Account Registration

To be eligible to use the platforms, you must create an account with a cellular/wireless telephone number and email that you own. During the registration process, or when you access the Platforms from a phone, your phone’s device ID is also stored. You agree that the Personal Information you provide to Us upon registration and at all other times will be true, accurate, current, and complete, and you agree to maintain and update this Personal Information with us as necessary. 

  •  You must be at least eighteen (18) years old to create an account, access, or use the Platforms. You must be able to form legally binding contracts under applicable law. Other restrictions may apply.
  • Registration and/or sign up as a User on thePlatform shall only be conducted by individuals who can form legally binding contracts under applicable law. 
  • It is a condition of Your use that all the information You provide on this Platform will be correct, current, and complete. If MoneyPigeon believes that the information You provide is not correct, or complete, MoneyPigeon has the right to refuse You access to this Platform or any of its resources and to terminate or suspend Your access at any time. 
  • To enable us to provide the Services to You on the Platform, You are required to provide including but not limited to your name, email address, text-enabled cellular/wireless telephone number, and street address or zip code. You are required to provide accurate, current, and complete information as well as maintain and update this Personal Information as necessary. 
  • We are required to assist in the fight against money laundering activities and the funding of terrorism by obtaining, verifying, and identifying information about all customers. We may therefore ask You to supply us with personal information relating to You or any Recipient, and we may also legally consult other sources or third parties to obtain information about You or any Recipient. 
  • When You register to use the Platform, You will be asked to create a password; to prevent fraud, You must keep this password confidential and must not disclose it or share it with anyone. If You know or suspect that someone else knows Your password, You should immediately change Your password and notify us by contacting immediately. 
  • You may only have one active Account. If we find that You are using multiple Accounts, we reserve the sole right and discretion to terminate one or more of the Accounts or refuse Your continued use of our services.
  • You should not use the Platform to send money except to people that you know. We are not responsible for, the quality or delivery of goods or services that you pay for using the Service. You accept that using the Service to pay for goods and services is at your own risk. 
  • MoneyPigeon may place certain restrictions on your Account, depending on your residence, location, compliance checks or regulatory requirements under applicable law. 
  • Your Account shall be used exclusively by You and You shall not transfer Your Account to any third party. If You authorize any third party to manage Your account on Your behalf, this shall be at Your own risk and MoneyPigeon shall not be liable to You in any way for any loss or liability arising from use by the third party. You may not submit or receive a transaction on behalf of any other person. 
  •  You must follow reasonable instructions which we give You or publish on our Platform from time to time which are intended to help You to safely use the Services. 
  •  If MoneyPigeon has a reason to believe that there is likely to be a breach of security or misuse of the Platform, we may require You to change Your password or we may suspend Your account. 

 

4. Use of the Platform

  • The Platform allows users to send international money transfers from the United States to other countries served by MoneyPigeon. You should only use the Platform to send money to people that You know personally, and not to pay for goods or services from third parties You do not know or trust. If You choose to pay third parties You do not know or trust for goods, please note that we have no control over, and are not responsible for safety, legality, or delivery of such goods or services and that any use of our Site and our Services is entirely at Your own risk. 
  • You must act on Your own behalf. You may not submit a Payment Instruction or receive a Payment Instruction on behalf of a third party. 
  • You must not use the Platform to send Money Transfer Amount in connection with illegal activity including but not limited to money laundering, fraud, and the funding of terrorist organizations. If we reasonably believe You are using the Platform in connection with illegal activity or for any fraudulent purpose, or are permitting a third party to do so, we shall report You to the appropriate legal authorities. You may not use the Service in violation of this Agreement or applicable laws, rules or regulations. It is a violation of the Agreement to use the Site for any of the following: sexually oriented materials or services, gambling activities, fraud, money-laundering, the funding of terrorist organizations, or the purchase or sale of tobacco, tobacco related paraphernalia, firearms, prescription drugs, or other controlled substances; or to send money to a Recipient that has violated the Agreement. If you use the Service in connection with illegal conduct, we will report you to law enforcement. Your Payment Instrument must be issued by a U.S. financial institution. We may refuse Transactions from you to certain Recipients that are included on the Specially Designated Nationals list, Non-cooperative Countries and Territories list, and such other lists as issued by different government agencies. 
  • Provided it would not be unlawful for us to do so, and it would not compromise reasonable security measures, we will contact You by phone or email if there is an actual or suspected fraud affecting Your use of the Platform, Your Account, or a security threat affecting the Platform, and the Services or Your Account.  
  •  Nothing in these Terms and Conditions or in any information provided by MoneyPigeon as part of the Services covered by these Terms and Condition is intended to be, nor should it be construed to be, legal or other advice. You must consult Your own professional advisers as to the effect of laws that may apply to Your use of the Services. 

– When using the Account or the Services, You must do the following; 

  • comply with this Terms and Conditions as well as any applicable laws, rules or regulations. 
  • provide confirmation of any information You provide to us, including proof of identity. 
  • co-operate in any investigation that we reasonably carry out, or that is carried out by any law enforcement agency, government agency or regulatory authority. 
  • not provide false, inaccurate or misleading information; and 
  • not use an anonymising proxy. 

 

 

5. Sending Money

-Sending Limits 

We may, at our discretion, impose limits on the amount of transactions you conduct through the Platform. Please see our FAQ’s for more details on limits. If we have authenticated your identity, we may increase your transaction limits. These limits may change from time to time at our sole discretion. You may not send money to your own account. 

Making payments 

  • When You give us a Payment Instruction, You are requesting that we process the Money Transfer on Your behalf and You are consenting to the execution of the Money Transfer. Your Payment Instruction will be treated as received by us once You submit it to us using the Site. 
  • It is Your responsibility to make sure all the details are accurate before You give us a Payment Instruction. Once we have received a Payment Instruction, it is not normally possible to change any details of that Payment Instruction. You will be given the opportunity to confirm a Payment Instruction before submission and You must check the details carefully.  
  • The total amount (the Money Transfer Amount, Service Fee and other applicable fees and charges) that You must pay and the relevant exchange rate (markup currency conversation rates may apply) selected by us will be displayed clearly on the Platform before You are asked to confirm Your Money Transfer. 
  • Where You pay a Money Transfer Amount in one currency from a card denominated in another currency, the conversion of the currencies and applicable markup fees, would be done by your financial institution. 

 

-There may be times when We have to convert the Money Transfer Amount from one currency into another. This could happen when: 

  • You pay a Money Transfer Amount in one currency and the payout amount is in another currency; In each case, there will be a difference between the exchange rate at which we buy foreign currency and the exchange rate provided to You. MoneyPigeon and its Service Providers usually make a small profit in these circumstances. In the case of a Money Transfer, we will pay the Recipient the amount we confirm to You in the local currency of the Recipient (where permitted by law) or in any currency permitted by applicable law or in the currency of the Money Transfer Amount subject to confirmation by us where this is applicable (which is on a case by case basis).  
  • Likewise, in the case of a payment to Your Account, we will issue money for the amount we confirm to You, in the currency in which Your Account is denominated subject to the applicable local laws. The margin taken on foreign currency exchange covers our risk that exchange rates may change between the time we confirm the payout amount (or the amount we will issue in money) and the time we make the payment (or issue the money). 
  • If the Recipient’s account is denominated in a currency other than the currency You instructed us to make payment in, there may be delays, additional charges or different exchange rates. 
  • We will have no responsibility for any fees or charges You may incur by the use of a particular account or Payment Instrument to fund a Money Transfer. These may include but are not limited to unauthorised overdraft fees imposed by banks if there are insufficient funds in Your bank account, or “cash advance” fees and additional interest which may be imposed by credit card providers if they treat use of our Services as a cash transaction rather than a purchase transaction. For example, some credit card issuers may treat the use of your credit card to use the Platform as a “cash advance” and may impose additional fees and interest cost for the transaction. We are not responsible for any NSF fees, or other, similar charges that might be imposed on you by your bank, credit card issuer, or other provider. 
  • In order to be able to process Your Payment Instruction, You must provide us with information as requested. Different information may be applicable to different countries. Payment Timelines 
  • Subject to the Terms and Conditions, where You make a Money Transfer, the recipient will receive the payment as set out on the platform. 
  • We may send and receive notifications in relation to Money Transfer by email and SMS. We will provide You with information after receipt of a Payment Instruction enabling You to identify the Money Transfer, along with details of the Money Transfer Amount in the currency used in the Payment Instruction, our Service Fee, exchange rate and the date on which the Payment Instruction was received. We will provide this information to You no later than 30 days after the date of the relevant Money Transfer. 
  • Your Money Transfer may be delayed by our effort to verify your identity and validate your Payment Instruction and otherwise comply with laws or manage our financial risk. 

 

-Default funding sources 

Your MoneyPigeon balance consists of the funds you have in your MoneyPigeon account that is available for new transactions and are not subject to pending transactions. When you make a payment through our Services, we first see if your balance can cover the transaction. You may also be able to fund payments with multiple options, designating one of these to be your primary funding source. We always use your MoneyPigeon balance first if the balance is sufficient to cover your payment. If there is not enough money available in your balance to cover the transaction, we will block the transaction from going through and prompt you to use other funding options, else, you’ll receive an “Insufficient Balance” notice. If you don’t want to use your balance, you can withdraw it at any time by Cashing Out to one of your linked bank accounts.  

 -Funding source limitations 

You may fund your transactions using a bank transfer, debit card, or crypto. In order to manage risk, we may limit the funding sources available for your use to fund any particular transaction. For example, we may limit the number of times a bank account or debit card can be used as a funding source. Please note that the various funding sources have different dispute resolution rights and procedures in the event your transaction turns out to be unsatisfactory. Your dispute resolution rights are determined by the funding source used to fund your transaction. 

 -Fees and charges 

MoneyPigeon is free to use and you will not be charged a fee by us for any action or transaction. However, we reserve the right to charge a fee for our services in the future. If we do, we will notify you and provide a grace period before any fees are implemented. 

 -Transaction reviews  

We review account and transaction activity at various times, including when you initiate a transfer of funds out of the Platforms. This review checks for, among other things, suspicious or illegal activity, and whether your account activity and the activity of users with whom you’ve transacted comply with this Agreement. Reviews may result in: 

  • Delayed, blocked or cancelled transfers. 
  • Funds being held by MoneyPigeon. 
  • Funds being applied to a negative MoneyPigeon account balance or used to offset loss incurred by MoneyPigeon. 
  • Account suspension or termination. 
  • Funds being seized to comply with a court order, warrant or other legal process; and/or
  • Funds you previously received being reversed (i.e., sent back to the sender’s MoneyPigeon balance.) 

In connection with our review process, you may be required to provide us with additional information and/or documentation to verify your identity. We may limit your account and your access to funds in it until verification is completed.  

 

6. Cancellation of Payment Instruction

  •  Once we have received Your Payment Instruction, You cannot cancel it. 
  •  Notwithstanding clause 6.1, we may, in our absolute discretion, attempt to reverse Your Payment Instruction if You have informed us that You wish us to do so. In some cases, we may have initiated an irreversible request for funds to be paid out to Your Recipient by a service provider. If this is the case, we cannot guarantee that the reversal will be successful. 
  • We may impose a charge for attempting to reverse Your Payment Instruction. 

7. Payment Investigation

Payment investigation is a process by which we review certain potentially high-risk transactions. If a payment is subject to payment investigation, we will place a hold on the payment and may provide notice to the recipient. We will conduct a review and either clear or cancel the payment. If the payment is cleared, we will provide notice to the recipient. Otherwise, Company will cancel the payment and the funds will be returned. We will provide notice to you by email and/or in the account history tab of your MoneyPigeon account if the payment is canceled. The Company also reserves the right to freeze or block accounts that we deem to have acquired funds illegitimately. Additionally, in the case you are unable to provide the original source of funds from your mobile money or bank account into MoneyPigeon, whereby investigations are ongoing, we also reserve the right to freeze your account. 

8. Risk of Reversals and Claims

When you receive a payment, you are liable to us for the full amount of the payment plus any fees if the payment is later invalidated for any reason. This means that, in addition to any other liability, you will be responsible for the amount of the payment, plus applicable fees if you lose a claim, or if there is a reversal of the payment. You agree to allow us to recover any amounts due to us by debiting your balance. If there are insufficient funds in your balance to cover your liability, you agree to reimburse us through other means. If we are unable to recover the funds from your primary funding source, we may attempt to contact you, we may recover the funds from your alternate funding sources, or may take other legal actions to collect the amount due, to the extent allowed by applicable law. 

 

9. Wallet Balance

  • If you hold a balance on the Platforms, we will hold your funds separate from our corporate funds, will not use your funds for our operating expenses or any other corporate purposes, and will not voluntarily make your funds available to our creditors in the event of bankruptcy. While your funds are in our custody, we will combine your funds with the funds of other users and place those pooled accounts in one or more bank accounts in our name. MoneyPigeon is not a bank or other chartered depository institution. Funds held by us or our service providers (including any bank service providers) in connection with the processing of transactions are not deposit obligations and are not insured for the benefit of the user by the Federal Deposit Insurance Corporation or any other governmental agency. Funds held in balance are an ancillary function of enabling money transmission and not for other benefit. 
  • If the balance in your account is negative for any reason, we may set off the negative balance by deducting amounts you owe us from money you receive into your account, or money you attempt to withdraw or send from your account. You agree to allow us to recover any amounts due to Company by debiting your balance. If there are insufficient funds in your balance to cover your liability, you agree to reimburse us through other means. If we are unable to recover the funds from your primary funding source, we may attempt to contact you, we may recover the funds from your alternate funding sources, or may take other legal actions to collect the amount due, to the extent allowed by applicable law. 
  • To secure your performance of this Agreement, you hereby grant to Company a lien on and security interest in your account and agree to execute any further documentation to perfect these Company rights. 

 

10. Closing Your Account

As long as there are no pending or in-progress transactions, you may close your account at any time. You may close your account by emailing us at [email protected] and requesting that we close your account. It may take up to 30 days for your account closure to be complete. You may not close your account to evade a payment investigation. If you attempt to close your account while we are conducting an investigation, we may hold your funds for up to 180 days to protect us or a third party against the risk of reversals, claims, fees, fines, penalties and other liability. You will remain liable for all obligations related to your account even after the account is closed. 

 

11. Account Hold and Reserves

For high volume accounts, including business accounts, we may, in our sole discretion, place a reserve on funds held in your account when we believe there may be a high level of risk associated with your account. If your account is subject to a reserve, we will provide you with notice specifying the terms of the reserve. The terms may require that a certain percentage of the amounts received into your account are held for a certain period of time, or that a certain amount of money is held in reserve, or anything else that we determine is necessary to protect against the risk associated with your account. Company may change the terms of the reserve at any time by providing you with notice of the new terms. 

12. Prohibited Acts

-You are prohibited from performing any of the following acts when using the Site: 

  • Use the Site for wrongful purposes. 
  • Infringement on intellectual property rights, portrait rights, publicity rights, or other rights of MoneyPigeon, customer or third parties. 
  • Infringement on the privacy of MoneyPigeon, customers or third parties. 
  •  Defamation, insults, or obstruction of business with respect to MoneyPigeon customers or third parties. 
  •  Acts that lead to fraud, blackmail, and other criminal activities. 
  •  Sending, transmitting, or recommending harmful computer programs such as computer viruses. 
  • Deliberate exposure or posting of false data. 
  • Sending or posing, information deemed by MoneyPigeon as falling under the following items. 
  • Expressions that induce, solicit or encourage suicide or self-injury behaviors, indecent expressions, information about dealing drugs or dangerous drugs, or expression that encourage the use of such drugs. 
  • Promotion and advertisement on religious activities, religious organizations, political activities or political organization.
  • Information that may have harmful effect on children. 
  • Cruel expressions, sexual expressions and other information that may bring discomfort to others. 

12. Privacy Policy

Your use of MoneyPigeon signifies Your continuing consent to MoneyPigeon’s Privacy Policy which You can examine any time by clicking of the Privacy Policy link on the Platform. Personal information that You supply to MoneyPigeon and any information about Your use of the Platform that we obtain will be subject to MoneyPigeon’s Privacy Policy on this Site. U.S. law requires we obtain, verify, and record information about you. We may require that you provide us with nonpublic, personal, identifying information. We may also lawfully obtain information about you from other sources without your knowledge, including non-personal identifying information that we may obtain while you visit this website. Please see our Privacy Policy. We may provide information about you and your Transactions to government authorities and law enforcement agencies, as described in our Privacy Policy. You authorize us to make any inquiries, to you or to others, which are necessary to validate the information that you provide to us. This may include asking you for additional information, requiring you to take steps to confirm ownership of your email address or financial instruments, verifying your information against third party databases, or through other sources. 

 

13. Availability of Platforms

  • Although we aim to offer You the best service possible, we make no promise that the Platforms will meet Your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Platform You should report it to and we will attempt to correct the fault as soon as we reasonably can.
  • Your access to the Platforms may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can. 

14. Proprietary Information

The material and content accessible from this Platform, and any other worldwide website owned, operated, licensed or controlled by MoneyPigeon is the proprietary information of MoneyPigeon. MoneyPigeon retains all rights, title, and interest in the content. Accordingly, the content may not be copied, distributed, republished, uploaded, posted or transmitted in any way without the prior written consent of MoneyPigeon, except that You may print out a copy of the Content solely for Your personal use. In doing so, You may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on any of the Content. Modification or use of the content except as expressly provided in these Terms and Conditions violates MoneyPigeon’s intellectual property rights. Neither title nor intellectual property rights are transferred to You by access to this Platform. 

15. Trademark

Trademarks, service marks, and logo appearing in this Platform are the property of MoneyPigeon or the party that provided the trademarks, service marks and logos to MoneyPigeon. MoneyPigeon and any party that provided trademarks, service marks and logos to MoneyPigeon retain all rights with respect to any of their respective trademarks, service marks, and logos appearing in this Platform. 

 

16. Right to Suspend or Cancel Registration

  • We may suspend or close Your Account  immediately at our reasonable discretion or if You breach any of Your obligations under these Terms and Conditions. 
  • You can close Your Account at any time by informing us in writing at [email protected]. If You do so, You must stop using the Platform. 
  • The suspension or cancellation of Your registration or Account and Your right to use the Platform shall not affect either party’s statutory rights or liabilities. 

 

17. Limitation of Liabilities and Disclaimer

  • Informing us about an unauthorized or incorrect payment You agree that if You believe that a Payment Instruction was made without Your authorization, or was not executed correctly by You, or where you have provided inaccurate information to Us, You must immediately contact us through the “Contact Us” channels listed in these Terms and Conditions. 
  • A request for a refund must be submitted in writing (including by email) to the contact points listed in these Terms and Conditions, giving Your details including full name, address, and phone number, together with the Transaction ID, Transaction Amount, and the reason for Your refund request. You should give us any other relevant documentation that You have available that will help us process Your claim. 
  • If You are entitled to a refund, we will credit the amount of the refund (less any fees we have charged) back to the source account and in the same currency in which the payment was made. 
  • If we suspect You have acted fraudulently, we may decide not to refund You or we may investigate the circumstances further. You must cooperate with us and law enforcement agencies, where they are involved in the investigation. If we carry out an investigation and decide that You are not entitled to a refund because You acted fraudulently, you may be liable for our reasonable costs in carrying out the investigation. We may deduct the reasonable costs incurred from the Money Transfer Amount and if the Money Transfer Amount is insufficient, You must repay the amount outstanding to us immediately on demand by us. 
  • We are not liable to You for any loss of profit, loss of business, business interruption, or loss of business opportunity. We are not liable to You for any loss or damage caused by a virus, or other technological attacks or harmful material that may infect your computer equipment or programmes, data or other material related to your use of the Services. 
  • THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APP ARE PROVIDED BY MONEYPIGEON ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. MONEYPIGEON MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE APP, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APP, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. 
  • TO THE FULL EXTENT PERMISSIBLE BY LAW, MONEYPIGEON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MONEYPIGEON DOES NOT WARRANT THAT THE SITE, INFORMATION, CONTENT, MATERIALS, PRODUCTS OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APP, OR ELECTRONIC COMMUNICATIONS SENT FROM MONEYPIGEON ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY LAW, MONEYPIGEON WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE APP, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APP, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING. 
  • You understand that MoneyPigeon cannot and does not guarantee or warrant that files available for downloading from the internet will be free of viruses, worms, Trojan horses, or other code that may manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy Your particular requirements for accuracy of data input and output, and for maintaining a means external to this Site for the reconstruction of any lost data. MoneyPigeon does not assume any responsibility or risk for Your use of the Internet. 
  • MONEYPIGEON, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, EVEN IF MONEYPIGEON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This Platform may be hyper-linked to other Platforms which are not maintained by or related to MoneyPigeon. MoneyPigeon has not reviewed any of such Platforms and is not responsible for the content of those Platforms. Hyper-Links are to be accessed at the user’s own risk, and MoneyPigeon makes no representations or warranties about the content, completeness, or accuracy of these hyper-links or the Platforms hyper-linked to this Platform. Further, the inclusion of any hyper-link to a third-party Platform does not necessarily imply endorsement by MoneyPigeon of that Platform. 

 

19. Security

You are prohibited from using any services or facilities provided in connection with this Platform to compromise security or tamper with system resources and or accounts. The use or distribution of tools designed for compromising security (e.g, password guessing programs, cracking tools, or network probing tools) is strictly prohibited. If You become involved in any violation of system security, MoneyPigeon reserves the right to investigate suspected violations of this Terms and Conditions. 

MoneyPigeon reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing MoneyPigeon to disclose the identity of anyone posting any e-mail messages or publishing or otherwise making available any materials that are believed to violate these Terms and Conditions. BY ACCEPTING THIS TERMS AND CONDITIONS YOU WAIVE AND HOLD HARMLESS MONEYPIGEON FROM ANY CLAIMS RESULTING FROM OR ANY ACTION TAKEN BY MONEYPIGEON DURING OR AS A RESULT OF ITS INVESTIGATIONS BY EITHER OR LAW ENFORCEMENT AUTHORITIES

20. Indemnity

  • You will indemnify and hold MoneyPigeon, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors and contractors (the indemnified parties) harmless from any breach of these Terms and Conditions by You, including any use of content other than as expressly authorized in these Terms and Conditions. You agree that the indemnified parties will have no liability in connection with any such breach or unauthorized use, and You agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses and attorney fees of the indemnified parties in connection therewith. You will also indemnify and hold the indemnified parties harmless from and against any claims brought by third parties arising out of Your use of the information accessed from this Site. 
  • You will indemnify and hold MoneyPigeon, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors and contractors (the indemnified parties) for authorizing any third party to manage Your account on Your behalf. 

 

21. Advertising and Sponsorship

Part of the Platform may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Platform complies with relevant laws and codes. We will not be responsible to You for any error or inaccuracy in advertising and sponsorship material. 

 

22. Applicable Law and Dispute Resolution

  • This Agreement shall be governed according to the laws of the State of Chicago, and all activities performed in connection with the Service shall be deemed to have been performed in Chicago. Any controversy, dispute, or claim arising out of or relating to the Service or Agreement (a “Claim”) shall be governed by and construed in accordance with the laws of the State of Chicago, except that body of law governing conflicts of law.
  • For customers in the US, any dispute, controversy, or claim arising out of or relating to this contract, including the formation, interpretation, breach or termination thereof, including whether the claims asserted are arbitrable, will be referred to and finally determined by arbitration in accordance with the JAMS International Arbitration Rules. The Tribunal will consist of three arbitrators. The place of arbitration will be San Francisco, California. The language to be used in the arbitral proceedings will be English. Judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.  

    For other regions, you may have the right to seek recourse from the Financial Ombudsman Service. The terms for seeking recourse from the Financial Ombudsman Service are stipulated in more detail on the website of the Financial Ombudsman Service at http://www.financial-ombudsman.org.uk If you are an individual, you could also submit your complaint through the European Commission’s Online Dispute Resolution website. The European Commission may then refer your complaint to the Financial Ombudsman Service. You can find more information at https://ec.europa.eu/consumers/odr/. 

23. Miscellaneous

  • You may not transfer any of Your rights under these Terms and Condition to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe Your rights will not be affected. 
  • If You breach these Terms and Conditions and MoneyPigeon chooses to ignore this, MoneyPigeon will still be entitled to use its Terms and Conditions.
  • MoneyPigeon shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control. 

24. Force Majeure

We shall not be liable for any failure or delay in the performance of the Service to the extent such failure or delay is caused by matters beyond our reasonable control, including, without limitation: changes in applicable laws; closure or unavailability of required physical and network infrastructure; sovereign default; power or internet failure; pandemic; disease; civil unrest; war; and earthquake, fire, flood, or other natural disasters.
